Terms & Conditions – General
• Specifications and prices are subject to change without notice
• MINIMUM ORDER: $100
• Terms: MasterCard® and Visa® are accepted. Payment terms for purchase orders are net 30 days from ship date with credit approval unless specified otherwise in writing. Payment in advance, wire transfer or letter of credit are required for sales outside the continental United States and Canada
• Delivery: From stock to 30 days after receipt of order unless specified otherwise
• FOB point: Colorado, U.S.A. or Manufacture location
• Shipping method: FedEx or DHL Ground unless specified otherwise
• Shipping charges: Added and invoiced
• Shipping Insurance: Added at replacement cost
• Currency: U.S. Dollars ($) or EURO depending on shipping location
• RUSH ORDER: $100 handling charge per item shipped or 5% of the total order whichever is greater
• There is an 11:00 AM (MST) deadline for any same day shipment. Orders that are placed after this time cannot be guaranteed to ship the same day
• Any order requiring same or next day shipment that needs testing and/or assembly will be subject to the expedite fee
• Validity of orders: No order is valid until accepted by Motor Diagnostic Systems or the Manufactures MDS represent
• Duration of quotations: Quotations are valid for 30-days from date on quote
• All accounts overdue will be charged a 1.5% surcharge per month on the amount overdue or a late fee of $25.00 whichever is greater. No exceptions!
• Restocking fees: Canceled or returned orders are subject to a 10% restocking fee
• Orders designated as custom orders require a 25% deposit upon ordering / 50% before shipping / 25% within 30 days of shipment, unless preapproved by the manufacture prior to acceptance

Terms & Conditions - Warranty/Continuing Support
• MDS extends support for its hardware and software products and warrants that its products are functional for the stated intended purposes as described in the product brochure of the manufacture. MDS extend no warrant other than those describe by the manufacture.
• EXCEPT AS SPECIFICALLY STATED IN THIS AGREEMENT, THE EQUIPMENT AND SOFTWARE IS PROVIDED AND LICENSED WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED OTHER THAN THAT WHICH IS EXPRESSED BY THE MANUFACTURES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF THE MANUFACTURES WE REPRESENT.
• IN NO EVENT WILL MDS OR ITS MANUFACTURES BE LIABLE TO YOU FOR ANY DAMAGES INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE EQUIPMENT / SOFTWARE EVEN IF MDS OR AN AUTHORIZED MDS REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY OTHER PARTY`
